Appeals Court Finds Gates Biased

FijiTimesOnline reports that Naitasiri High Chief Rt Inoke Takiveikata has won his appeal and will have a fresh trial. You can read the full story here.

This is another tremendous blow for Baini Marama and his illegal IG as Rt Inoke had been on the military’s Most Wanted List ever since 2/11.

The possiblitty that he may one day walk free is making Baini’s blood boil and causing his blood pressure to rise to near unmanageable levels.

In their ruling, the Appeals Court said they believed the evidence of Mr and Mrs Brody that poser CJ Anthony Gates did in fact boast to them at a cocktail party that he was going to “put away” the Naitasiri High Chief, and this was before he had even heard the case.

Put simply, this means Gates had already made up his mind that Rt Inoke was guilty. In law, this means Gates was biased and so a new trial is required - with a new trial judge.

The real question on everyone’s mind is - what does a person pretending to be Chief Justice do if he finds himself in this position?

Should he resign?

Afterall, he has been proven to be a biased Judge. This is really bad especially if you are the Chief Judge.

HnC understands that many people in the legal fratenity now believe this man should have the decency and professional integrity to just hang up his wig (and robe) and retire from the judiciary - the sooner the better!

HnC beleives that the President of the Baini Marama fanclub Isikeli Mataitoga will be selected to preside over Rt Inoke’s case next time around.

Also look out for Devendra Pathik who was proudly standing next to I-Arse Khaiyum on TV the other night and shaking Baini’s hand as if his life depended on it.

Is it possible we just saw a glimpse of the next FICAC Commissioner or Chief Justice?

I guess only time will tell…
